Introduction

These conditions apply to information obtained from the Department of Conservation's implemented and ongoing monitoring programmes.

General

These conditions apply to information obtained from the New Zealand Department of Conservation (DOC). For some products and services additional conditions may apply. Where additional conditions apply, they will be part of the documentation for those products and services. We reserve the right to amend the terms of use.

The data are the property of the Crown. This is a strategic resource ‘owned’ by the Government as a steward on behalf of the public. It is subject to official information legislation.

Crown copyright ©. All data and other material produced by the Department of Conservation constitutes Crown copyright administered by the Department of Conservation.

Unless otherwise specified, content produced by the Department of Conservation is licensed under a Creative Commons Attribution 4.0 International License. In essence you are free to copy and adapt the work, as long as you attribute the work to the Department of Conservation and abide by the other licence terms.

Note that no departmental or governmental emblem, logo, or coat of arms may be used in any way which infringes any provision of the Flags, Emblems, and Names Protection Act 1981 or would infringe such provision if the relevant use occurred within New Zealand. Attribution to the Department of Conservation should be in written form and not by reproduction of any such emblem, logo, or coat of arms.

Copyright Obligations

All proprietary rights to the intellectual property in the data or information remain with the Crown as its sole property.

Modification of the data and information or the addition of the information does not confer copyright or any other form of property of the original material to a user.

All outputs (e.g maps, publications, reports) that are derived from the data or information must acknowledge the Crown copyright, in the following way:

If you publish, distribute, or otherwise disseminate this information to the public without adapting it, the following attribution to the Department of Conservation should be used:

Quality of statistical data

All statistical data are subject to error, either through incompleteness of response or by way of limitations imposed by the design of the survey. The data are supplied with no assurance being given to the quality or completeness of the dataset.

The quality of such statistical data should always be assessed before deciding on its fitness for the tasks to which it's to be used.  We recommend that users exercise their own skill and care in deriving conclusions from any data or information supplied.

 We recommend that users carefully evaluate the accuracy, currency, completeness, and relevance of the material supplied here for their purposes.  Any use of the data or information supplied should state when the data or information was acquired. Authorised users will advise the Department of Conservation of any errors detected while using this data.

If requested, authorised users will provide the Department of Conservation with copies of the work completed using this data, in keeping with our reporting requirements to Cabinet.

Liability

While care has been used in processing, analysing, and extracting information, we (the Department of Conservation) give no warranty that the information supplied is free from error. We shall not be liable for any loss suffered through the use, directly or indirectly, of any information, product, or service.

DOC makes no warranties or representations as to possible infringement upon copyrights or other intellectual property rights of others in the data or information.

DOC will not accept liability for any direct, indirect, special or consequential damages, losses or expenses howsoever arising and relating to use, or lack of use, of the data or information supplied.

Charging, where required

The Department of Conservation may charge for some official information requests in accordance with the Ministry of Justice Charging Guidelines for Official Information Act 1982 Requests.
