Introduction

A judicial review has been filed by the Otago Rock Lobster Industry Association Inc. in relation to decisions by former Ministers for the declaration of six new marine reserves in the southeast South Island.

The proceeding challenges decisions made by the former Minister of Conservation, Minister of Transport and Minister for Oceans and Fisheries in respect of six marine reserves, and particularly those relating to the Te Umukōau Marine Reserve. The decisions were made under the Marine Reserves Act 1971.

The High Court has directed that any interested parties are to inform the Court of their intention to join or intervene in the proceeding by 23 August 2024. Some organisations that submitted during the public consultation process have already been served or notified about the proceeding.

If you consider you have an interest in the proceeding, you should seek legal advice.
